1. Acceptance of Terms
By accessing or using the Track Day Xperience ("TDX," "we," "us," or "our") website at hpde.app (the "Site"), creating an account, registering for an event, or purchasing any product or service, you agree to be bound by these Terms of Service ("Terms"). If you do not agree to all of these Terms, you may not access or use the Site or participate in our events.
2. Eligibility
You must be at least 18 years of age to register for and participate in TDX events. Participants under 18 may be permitted with a parent or legal guardian's signed waiver and must be accompanied at all times. You must possess a valid U.S. driver's license to operate a vehicle at any TDX event.
3. Event Registration & Payment
- All event registrations are processed through our website or authorized third-party platforms.
- Full payment is required at the time of registration.
- Prices are listed in U.S. Dollars (USD) and are subject to change without notice.
- Registration is not confirmed until payment is received and you receive a confirmation email.
4. Cancellation & Refund Policy
- More than 14 days before event: Full refund minus a $50 processing fee, or transfer to a future event at no charge.
- 7–14 days before event: 50% refund or credit toward a future event.
- Less than 7 days before event: No refund. Credit toward a future event at TDX's discretion.
- No-shows: No refund or credit.
- Event cancellation by TDX: If TDX cancels an event due to weather, facility issues, or other circumstances, participants will receive a full refund or transfer to a future event.
5. Assumption of Risk & Waiver of Liability
Participation in high performance driving events (HPDE) involves inherent and significant risks, including but not limited to vehicle damage, personal injury, and death. By registering for and participating in any TDX event, you:
- Acknowledge and voluntarily assume all risks associated with participation.
- Will be required to sign a comprehensive waiver and release of liability prior to accessing the track.
- Release TDX, its owners, employees, contractors, instructors, and the track facility from any and all claims, damages, losses, or injuries arising from participation.
- Understand that no insurance is provided by TDX for participants or their vehicles.
6. Vehicle Requirements
- All vehicles must pass a pre-event technical inspection ("tech inspection") before being permitted on track.
- Vehicles must be mechanically sound with proper fluids, brakes, tires, and safety equipment.
- TDX reserves the right to deny any vehicle entry to the track at its sole discretion.
- Convertible vehicles require a roll bar or roll cage (hardtops may be exempt at TDX's discretion).
7. Code of Conduct
All participants agree to:
- Obey all flag signals and corner worker instructions at all times.
- Follow the passing rules for their assigned run group.
- Maintain safe, respectful behavior on and off track.
- Refrain from the use of alcohol or controlled substances before or during track sessions.
- Treat all staff, instructors, corner workers, and fellow participants with respect.
TDX reserves the right to remove any participant from an event for unsafe driving, unsportsmanlike conduct, or violation of any rules — without refund.
8. Intellectual Property
All content on the Site — including text, graphics, logos, images, videos, and software — is the property of Track Day Xperience or its content providers and is protected by U.S. copyright and trademark laws. You may not reproduce, distribute, or create derivative works without prior written consent.
9. User Accounts
- You are responsible for maintaining the confidentiality of your account credentials.
- You are responsible for all activity under your account.
- You must provide accurate and complete registration information.
- TDX reserves the right to terminate accounts at its discretion.
10. Gift Cards
- Gift cards are non-refundable and have no expiration date.
- Gift cards may be redeemed for any TDX event or service.
- Lost or stolen gift cards will not be replaced.
- Gift cards cannot be exchanged for cash.
11. Limitation of Liability
To the maximum extent permitted by applicable law, TDX and its affiliates shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising out of your use of the Site or participation in our events. Our total liability for any claim shall not exceed the amount you paid for the specific event or service giving rise to the claim.
12. Indemnification
You agree to indemnify, defend, and hold harmless TDX, its officers, directors, employees, agents, and affiliates from any claims, damages, losses, liabilities, and expenses (including reasonable attorneys' fees) arising from your use of the Site, participation in events, or violation of these Terms.
13. Governing Law & Disputes
These Terms shall be governed by the laws of the State of Florida, without regard to conflict of law principles. Any disputes arising under these Terms shall be resolved exclusively in the state or federal courts located in Indian River County, Florida.
14. Modifications
TDX reserves the right to modify these Terms at any time. Changes will be posted on this page with an updated "Last updated" date. Your continued use of the Site after changes are posted constitutes acceptance of the modified Terms.
